Welcome to Sun E Tourism | Sun E Bike Spain. These Terms of Service govern the rental of bicycles, e-bikes, and related equipment (“Bicycle”) and are entered into by and between Sun E Tourism | Sun E Bike Spain (“Lessor”) and you (“Renter”).

By renting a Bicycle, you agree to be bound by these Terms of Service. Please read them carefully.

Definitions

• Bicycle: A one, two, or more wheeled vehicle powered by muscle power via pedals or muscle power as in a step.
• Tenant: The legal person who enters into the rental agreement as a tenant.
• Landlord: Sun E Tourism | Sun E Bike Spain, who concludes the rental agreement as lessor.
• Damage of the Lessor: Financial loss suffered by the lessor due to damage or loss of the Bicycle or its accessories.
• Rider: The actual driver of the Bicycle.

Applicability

1. These Terms of Service apply to every rental agreement between Sun E Tourism | Sun E Bike Spain and the Renter.
2. Any deviations from these Terms must be confirmed in writing in a rental agreement.

Rental Agreement

• The agreement is concluded by written acceptance of the offer.
• The rental fee is calculated based on the number of Bicycles, rental period, and location of delivery and collection.
• The Renter will have access to a Bicycle for the duration of the rental period.

Rental Period

• The Bicycle must be returned by the end of the rental period at the location specified in the rental agreement.
• Late returns may incur additional charges.

Payment

• The rental sum must be paid at the start of the rental period.
• A deposit of EUR 100 per rented Bicycle is required.

Obligations of the Tenant

• The Renter is responsible for any damage or loss to the Bicycle.
• The Bicycle must be used in accordance with its intended use and must be properly locked when unattended.

Obligations of the Lessor

• The Lessor will provide a Bicycle in good condition, complete with all agreed accessories and specifications.
• In the event of a breakdown, the Lessor will offer replacement transport.

Damage and Missing Items

• he Renter is liable for any damage to or loss of the Bicycle.
• In the event of damage, the Renter must report it to Sun E Tourism | Sun E Bike Spain.

Liability

• The use of the Bicycle is at the Renter’s own risk.
• The Lessor is not liable for any damage suffered by the Renter unless there is intent or gross negligence on the part of the Lessor.

Force Majeure

• Neither party is liable for failure to fulfill obligations due to circumstances beyond their control.

Amendment of the Agreement

• Any changes to the agreement must be made in writing and agreed upon by both parties.

Disputes

• All disputes will be submitted exclusively to the court and are governed by Spanish law.

Applicable Law

• This agreement is exclusively governed by Spanish law.
